Terms & Conditions of Sale, Entry and Participation

IMPORTANT NOTICE

PLEASE READ THESE TERMS CAREFULLY BEFORE PURCHASING TICKETS OR ENTERING LUMA KIDS

Welcome to Luma Kids. To ensure a safe, enjoyable, and memorable experience for all guests, please read the following Terms and Conditions carefully. By purchasing a ticket, making a booking, or entering the Luma Kids premises, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.

 

  1. Definitions

Luma Kids Pty Ltd (“Luma Kids”, “we”, “our”, or “us”) provides indoor play, entertainment, party, café, and recreational facilities for children and their families. Entry to and use of our premises is subject to these Terms and Conditions and all posted safety rules and staff directions

 

  1. Acceptance of these Terms

By purchasing tickets, booking online, entering the Venue or participating in any activity, you agree to these Terms and Conditions.

If you do not agree, you must not enter or participate

 

  1. Assumption of Risk

Participation in recreational activities involves inherent risks.

These risks include, but are not limited to:

* slips

* trips

* falls

* collisions

* impact injuries

* equipment failure

* physical exertion

* injury caused by other participants

 Serious injury, permanent disability or death may occur despite reasonable safety precautions.

By entering our premises, you acknowledge and accept these risks and agree to participate at your own risk.

 

  1. Limitation of Liability

To the maximum extent permitted by law, Luma Kids excludes all liability for:

* personal injury

* illness

* property loss

* property damage

* financial loss

* consequential loss

 arising from participation in recreational activities. Nothing in these Terms excludes rights that cannot legally be excluded under Australian Consumer Law.

  1. Medical Conditions

Participants should only participate if they are in good physical health.

You must not participate if you:

* have a contagious illness

* have a condition that may place yourself or others at risk

* are under the influence of alcohol or drugs

* are wearing a cast or medical brace that may affect safe participation

 

Pregnant participants should seek medical advice before participating.

If in doubt, please consult your medical practitioner before attending.

 

  1. Medical Treatment

In the event of illness or injury, you authorise Luma Kids staff to obtain medical assistance, including contacting emergency services if considered necessary.

Any medical, ambulance, or related costs remain the responsibility of the participant or their parent or guardian.

 

  1. Supervision of Children

 

Children must be supervised by a responsible adult (18 years or older) at all times while visiting Luma Kids.

Parents and guardians remain solely responsible for the behaviour, supervision, and safety of the children in their care throughout their visit.

Luma Kids staff supervise the facility only and are not responsible for supervising individual children.

Parents and guardians are responsible for:

 

* supervising children

* ensuring rules are followed

* behaviour of children

* children’s safety

 

  1. Behaviour

Guests must:

* follow all safety signage

* comply with staff instructions

* treat staff and guests respectfully

* use equipment correctly

*  Refrain from dangerous, reckless, abusive, or disruptive behaviour.

 

Luma Kids reserves the right to refuse entry or remove any guest without refund where behaviour places others at risk or disrupts the enjoyment of other guests.

 

  1. Safety Rules

Guests must:

* wear grip socks while using play equipment

* remove sharp objects

* secure loose clothing where necessary

* not bring prohibited items onto equipment

* report hazards immediately

Failure to follow safety rules may result in removal from the Venue.

 

  1. Photography and CCTV

CCTV operates throughout the premises for safety and security purposes.

Photographs and videos may occasionally be taken for promotional purposes. By entering Luma Kids, you consent to the use of images in which you or your child may reasonably appear unless you notify our staff before your visit.

 

  1. Personal Property

Guests are responsible for their own belongings.

Luma Kids accepts no responsibility for lost, stolen or damaged personal property.

 

  1. Tickets and Bookings

Tickets:

* are valid only for the booked session

* remain the property of Luma Kids

* cannot be copied or fraudulently reproduced

* may not be resold for commercial purposes

Luma Kids reserves the right to refuse entry where tickets have been altered or obtained unlawfully.

 

  1. Party Bookings

Birthday Party Terms & Conditions

  • Party bookings can be made online, in person or by phone.
  • A $100 deposit is required to secure a party booking.
  • Birthday parties require a minimum of 8 children.
  • Balloons must be secured with weights, and decorations must not create a safety hazard or damage the venue.
  • Glitter, confetti, silly string and similar items are not permitted.
  • Luma Kids may require any unsafe or unsuitable decorations to be removed.
  • Guest numbers can be adjusted up to 5 days before the party.
  • The confirmed number of guests will be the minimum number payable on the day.
  • If you cancel more than 14 days before your party, you may choose to:

– rebook your party for another available date within 6 months; or

– receive the deposit as Luma Kids store credit.

  • If you cancel within 14 days of your party, the $100 deposit is non-refundable.
  • Party deposits are non-refundable unless otherwise stated in these Terms & Conditions.
  • All party bookings are also subject to these General Terms & Conditions and any additional safety rules or instructions provided by Luma Kids.

 

  1. Refunds, Cancellations and Transfers

General admission tickets are non-refundable.

Bookings may be transferred or rescheduled with at least 24 hours’ notice, subject to availability.

Party deposits are non-refundable unless otherwise agreed by Luma Kids.

If Luma Kids cancels a booking due to unforeseen operational circumstances, customers will be offered an alternative booking or other appropriate remedy.

  1. Food

Outside food is not permitted except:

* birthday cakes for booked parties

* infant food

* food required for medical or allergy reasons

Luma kids is not a nut free centre. Guests with allergies should advise staff before entering.

Luma Kids cannot guarantee that food is completely free from allergens.

  1. Website Use

By using the Luma Kids website, you agree:

* information is provided for general purposes only

* prices and availability may change

* occasional errors may occur

* Luma Kids may update website content without notice

  1. Online Orders

When purchasing online, you must provide accurate:

* name

* phone number

* email address

* payment information

* booking details

Orders are confirmed once payment has been successfully processed.

Confirmation will be sent to your nominated email address.

  1. Pricing

All prices displayed are in Australian Dollars (AUD).

Luma Kids reserves the right to correct pricing errors and cancel orders affected by genuine pricing mistakes.

Where payment has already been processed, a full refund will be issued.

  1. Website Security

Payments are processed through secure third-party payment providers.

While Luma Kids uses reasonable security measures, no internet transmission can be guaranteed to be completely secure.

To the extent permitted by law, Luma Kids accepts no liability arising from unauthorised access to information transmitted over the internet.

  1. Intellectual Property

All content on the Luma Kids website, including logos, graphics, photographs, videos, text and branding, is owned by or licensed to Luma Kids Pty Ltd.

No material may be reproduced without written permission.

  1. Changes to these Terms

Luma Kids may update these Terms at any time.

The latest version will always be published on our website.

Declaration

 

By purchasing tickets, making a booking, selecting “I Agree”, or entering Luma Kids, you acknowledge that:

* You have read and understood these Terms and Conditions.

* You voluntarily accept the inherent risks associated with recreational activities.

* You agree to comply with all Venue rules and staff directions.

* Where you are acting for another person or child, you are authorised to accept these Terms on their behalf.

 

Important Safety Notice

Luma Kids is committed to providing a safe and enjoyable environment for children and families. However, indoor play activities involve inherent risks, including slips, trips, falls, collisions and other injuries.

By participating in activities at Luma Kids, you acknowledge and accept the ordinary risks associated with recreational play and agree to follow all safety instructions.

Nothing in these Terms & Conditions excludes, restricts or modifies any rights or guarantees that cannot legally be excluded under the Australian Consumer Law or other applicable laws.
